Foucault\u2019nun \u015fu s\u00f6z\u00fc durumu \u00f6zetler nitelikte: \u201c\u0130ktidar konu\u015fmay\u0131 engellemez; konu\u015fulabilir olan\u0131 yeniden \u015fekillendirir.\u201d<\/strong><\/p>\n<p data-start=\"117\" data-end=\"582\">\u00dclkede s\u0131k s\u0131k ya\u015fad\u0131\u011f\u0131m\u0131z sans\u00fcr, eri\u015fim engeli, k\u0131s\u0131tlama ve hatta yay\u0131n organlar\u0131na d\u00f6n\u00fck silahl\u0131 sald\u0131r\u0131lar bizlere ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcm\u00fcz\u00fcn var olup olmad\u0131\u011f\u0131n\u0131 sorgulat\u0131yor. Ge\u00e7ti\u011fimiz g\u00fcnlerde Evrensel Gazetesi\u2019nin u\u011frad\u0131\u011f\u0131 silahl\u0131 sald\u0131r\u0131, yak\u0131n zamanda Leman dergisine y\u00f6nelik hedef g\u00f6stermeler, Yeni Ya\u015fam ve Xweb\u00fbn gazetelerine, Ajansa Welat\u2019a, kimi dergi ve ki\u015filerin sosyal medya hesaplar\u0131na gelen eri\u015fim engelleri \u201c\u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fcm\u00fcz nerede?\u201d dedirtiyor.<\/p>\n<p data-start=\"584\" data-end=\"1157\">\u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fc, bireylerin ya da topluluklar\u0131n d\u00fc\u015f\u00fcnce ve g\u00f6r\u00fc\u015flerini herhangi bir engelle kar\u015f\u0131la\u015fmadan dile getirebilmesidir. Bu, en temel insani haklardan biridir ve \u0130nsan Haklar\u0131 Evrensel Beyannamesi ba\u015fta olmak \u00fczere bir\u00e7ok \u00fclkenin yasalar\u0131nda g\u00fcvence alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Kendini ifade edememek ise en a\u011f\u0131r esaret anlam\u0131na gelir. \u00c7\u00fcnk\u00fc insan ya\u015fam\u0131n\u0131n b\u00fcy\u00fck bir b\u00f6l\u00fcm\u00fc kendini ifade etme ihtiyac\u0131ndan do\u011far; hatta ya\u015fam\u0131n kendisi en geni\u015f anlam\u0131yla bir kendini ifade etme olay\u0131d\u0131r. Bu nedenle ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc yaln\u0131zca bas\u0131n-yay\u0131n faaliyetleri kapsam\u0131nda d\u00fc\u015f\u00fcn\u00fclemez.<\/p>\n<p data-start=\"1159\" data-end=\"1533\">Anayasan\u0131n 26. maddesine g\u00f6re \u201cHerkes d\u00fc\u015f\u00fcnce ve kanaatlerini s\u00f6z, yaz\u0131, resim veya ba\u015fka yollarla tek ba\u015f\u0131na veya toplu olarak yayma hakk\u0131na sahiptir.\u201d Ancak k\u00e2\u011f\u0131t \u00fczerinde tan\u0131nan bu hak, pratikte her g\u00fcn ihlal ediliyor. \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fc temel bir hakt\u0131r ve toplumun geli\u015fip ilerleyebilmesi i\u00e7in de \u015fartt\u0131r. \u00c7\u00fcnk\u00fc a\u00e7\u0131kt\u0131r ki fikirleri bast\u0131rmak, do\u011fruyu bulmay\u0131 engeller.<\/p>\n<p data-start=\"1535\" data-end=\"1960\">\u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve Anayasa\u2019n\u0131n 216. maddesi \u201chalk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik\u201d su\u00e7lamas\u0131 aras\u0131ndaki \u00e7izgiyi yeniden ele almak gerekir. Bir s\u00f6z ancak a\u00e7\u0131k\u00e7a ve do\u011frudan bir ki\u015fiye veya bir topluma zarar verme riski ta\u015f\u0131yorsa tehdit veya su\u00e7 say\u0131labilir. Bunun d\u0131\u015f\u0131ndaki durumlar\u0131 bu maddeyle ba\u011fda\u015ft\u0131rmak kabul edilemez bir tutumdur. Bug\u00fcn ya\u015fanan t\u00fcm keyfi yasaklar\u0131n ve sans\u00fcrlerin neredeyse tamam\u0131 bu temele dayand\u0131r\u0131l\u0131yor.<\/p>\n<p data-start=\"1962\" data-end=\"2321\">\u0130\u00e7inde bulundu\u011fumuz \u00e7a\u011f bize birtak\u0131m \u00e7er\u00e7eveler \u00e7izmi\u015f durumda ve biz bunlar\u0131 a\u015fam\u0131yoruz. Adeta bir \u00f6zg\u00fcrl\u00fck yan\u0131lsamas\u0131 i\u00e7indeyiz. Anayasa bizlere kendimizi ifade etme, fikirlerimizi beyan etme olana\u011f\u0131 sa\u011flarken, ayn\u0131 zamanda belirli s\u00f6ylemlerimizi bast\u0131rmak i\u00e7in de kullan\u0131l\u0131yor. Bu \u00e7eli\u015fkili durum sadece T\u00fcrkiye\u2019ye \u00f6zg\u00fc de\u011fil; d\u00fcnya \u00e7ap\u0131nda ge\u00e7erlidir.<\/p>\n<p data-start=\"2323\" data-end=\"2669\">\u00d6rne\u011fin, ge\u00e7ti\u011fimiz y\u0131llarda Fransa\u2019daki Charlie Hebdo mizah dergisine yap\u0131lan silahl\u0131 sald\u0131r\u0131da 12 ki\u015fi hayat\u0131n\u0131 kaybetmi\u015fti. Bu olay, d\u00fcnya \u00e7ap\u0131nda ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc tart\u0131\u015fmalar\u0131n\u0131 yeniden g\u00fcndeme getirdi. A\u00e7\u0131k\u00e7a g\u00f6r\u00fcld\u00fc\u011f\u00fc gibi kendilerini \u00f6zg\u00fcrl\u00fc\u011f\u00fcn \u00fclkesi olarak tan\u0131mlayan Amerika ve Avrupa \u00fclkelerinde de sistem benzer \u015fekilde i\u015flemektedir.<\/p>\n<p data-start=\"2671\" data-end=\"2915\">\u0130ktidar\u0131n s\u00f6ylem d\u00fczeni, halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa te\u015fvik etmek ile ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc aras\u0131ndaki s\u0131n\u0131rlar\u0131 mu\u011flakla\u015ft\u0131r\u0131yor.
