HABER MERKEZ\u0130-Defalarca tahliyesi talep edilen ve cezaevinde engelli hale gelen hasta tutsak F\u0131rat Nebio\u011flu, Anayasa Mahkemesi\u2019nin “\u00f6rg\u00fcte \u00fcye olmamakla birlikte \u00f6rg\u00fct ad\u0131na su\u00e7 i\u015flemek” maddesini iptal etmesinin ard\u0131ndan serbest b\u0131rak\u0131ld\u0131.<\/p>\n
Diyarbak\u0131r 1 No\u2019lu Y\u00fcksek G\u00fcvenlikli Kapal\u0131 Cezaevi\u2019nde tutuklu bulunan engelli a\u011f\u0131r hasta tutsak F\u0131rat Nebio\u011flu hakk\u0131nda tahliye karar\u0131 verildi. Cezaevinden \u00e7\u0131kan Nebio\u011flu’nun, ailesiyle birlikte memleketi \u00calih’e ge\u00e7ti\u011fi belirtildi.<\/p>\n
\u00calih’te 2015 y\u0131l\u0131nda tutuklanan Nebio\u011flu\u2019na yarg\u0131land\u0131\u011f\u0131 davada “\u00d6rg\u00fct \u00fcyesi olmak” ile “\u00d6rg\u00fcte \u00fcye olmamakla birlikte \u00f6rg\u00fct ad\u0131na su\u00e7 i\u015flemek” iddialar\u0131ndan toplam 14 y\u0131l 6 ay hapis cezas\u0131 verildi. Nebio\u011flu, cezaevinde ge\u00e7irdi\u011fi fel\u00e7 nedeniyle y\u00fczde 92 engelli duruma geldi. Ayr\u0131ca b\u00f6brek yetmezli\u011finin yan\u0131 s\u0131ra g\u00f6rme ve i\u015fitme kayb\u0131 gibi sa\u011fl\u0131k sorunlar\u0131 da ya\u015fayan Nebio\u011flu, haftan\u0131n 3 g\u00fcn\u00fc diyalize girmek zorunda. Batman E\u011fitim ve Ara\u015ft\u0131rma Hastanesi, b\u00f6brek yetmezli\u011fi nedeniyle Nebio\u011flu hakk\u0131nda \u201ccezaevinde kalamaz\u201d raporu verdi. Ancak Adli T\u0131p Kurumu (ATK), 14 Mart 2022 tarihinde \u201ccezaevinde kalabilir\u201d y\u00f6n\u00fcnde rapor haz\u0131rlad\u0131. Nebio\u011flu’nun b\u00f6brek nakli olmas\u0131 i\u00e7in yap\u0131lan 7 ba\u015fvuruya olumlu d\u00f6n\u00fc\u015f yap\u0131lmad\u0131.<\/p>\n
Anayasa Mahkemesi (AYM) taraf\u0131ndan 2023 y\u0131l\u0131nda T\u00fcrk Ceza Kanunu\u2019nun (TCK) 220\u2019nci maddesinde d\u00fczenlenen “\u00d6rg\u00fcte \u00fcye olmamakla birlikte \u00f6rg\u00fct ad\u0131na su\u00e7 i\u015fleme\u201d kural\u0131 iptal edildi. Nebio\u011flu hakk\u0131nda s\u00f6z konusu maddeden verilen 5 y\u0131l 7 ayl\u0131k cezan\u0131n iptali i\u00e7in yap\u0131lan ba\u015fvuru reddedildi. Batman 2\u2019inci A\u011f\u0131r Ceza Mahkemesi, \u201cdavan\u0131n yeniden g\u00f6r\u00fclmesi\u201d ve \u201cinfaz\u0131n\u0131n durdurulmas\u0131 ve tahliye\u201d talepli ba\u015fvurular\u0131 reddetti. Ailenin bir \u00fcst mahkemeye ba\u015fvurusu da reddedildi.<\/p>\n
Nebio\u011flu, AYM’nin 9 Ocak\u2019ta verdi\u011fi karar do\u011frultusunda “\u00f6rg\u00fcte \u00fcye olmamakla birlikte \u00f6rg\u00fct ad\u0131na su\u00e7 i\u015flemek” maddesinin iptal edilmesi \u00fczerine tahliye edildi.<\/p>\n","protected":false},"excerpt":{"rendered":"
