\u0130zmir\u2019de dijital medya hesab\u0131ndan payla\u015ft\u0131\u011f\u0131 sa\u00e7 \u00f6rme videosu nedeniyle \u201c\u00d6rg\u00fct propagandas\u0131 yapmak\u201d iddias\u0131yla 5 \u015eubat\u2019ta tutuklanan 16 ya\u015f\u0131ndaki A.K., hakk\u0131nda verilen ceza \u0130stinaf taraf\u0131ndan bozuldu.<\/p>\n

\u015eakran Kapal\u0131 Kad\u0131n Cezaevi\u2019nde 26 g\u00fcnl\u00fck tutsakl\u0131\u011f\u0131n\u0131n ard\u0131ndan 3 Mart 2026 tarihinde tahliye edilen A.K.\u2019ye \u0130zmir 2\u2019nci \u00c7ocuk A\u011f\u0131r Ceza Mahkemesi 7 May\u0131s\u2019ta, \u201cBas\u0131n ve yay\u0131n yoluyla propaganda\u201d su\u00e7lamas\u0131yla 10 ay hapis cezas\u0131 verdi ve h\u00fckm\u00fcn a\u00e7\u0131klanmas\u0131n\u0131n geri b\u0131rak\u0131lmas\u0131na karar verdi.<\/p>\n

MA’da yer alan habere g\u00f6re<\/a>, verilen 10 ayl\u0131k hapis cezas\u0131na kar\u015f\u0131 \u0130stinaf Mahkemesi\u2019ne yap\u0131lan ba\u015fvuru sonucunda \u0130zmir B\u00f6lge Adliye Mahkemesi 2\u2019nci Ceza Dairesi, 23 Eyl\u00fcl\u2019de mahkumiyet h\u00fckm\u00fcn\u00fc kald\u0131rarak, A.K\u2019nin beraatine karar verdi. \u0130zmir B\u00f6lge Adliye Mahkemesi Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131 da \u201cPayla\u015f\u0131m\u0131n muhatap kitle \u00fczerinde a\u00e7\u0131k ve yak\u0131n tehlike olu\u015fturdu\u011fu ve \u00f6rg\u00fct\u00fcn \u015fiddet y\u00f6ntemlerini me\u015fru g\u00f6sterme\u201d iddias\u0131yla beraat karar\u0131na kar\u015f\u0131 temyiz kanun yoluna ba\u015fvurdu.<\/p>\n

A.K\u2019nin avukat\u0131 Ethem Kuru\u015f, \u0130zmir B\u00f6lge Adliye Mahkemesi 2\u2019nci Ceza Dairesi\u2019nin oybirli\u011fiyle verdi\u011fi beraat karar\u0131nda somut olayda hi\u00e7bir cebir, \u015fiddet veya tehdit unsurunun bulunmad\u0131\u011f\u0131n\u0131, su\u00e7un maddi ve manevi hi\u00e7bir yasal unsurunun olu\u015fmad\u0131\u011f\u0131n\u0131 ve demokratik bir toplumda d\u00fc\u015f\u00fcnce ve ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn keyfi su\u00e7lamalarla engellenemeyece\u011finin hukuki bir kesinlikle ortaya konuldu\u011funu belirtti.<\/p>\n

Mahkeme karar\u0131nda belirtilen haks\u0131z tutukluluk tazminat\u0131na ili\u015fkin yasal hak s\u00fcrecini sonuna kadar kullanacaklar\u0131n\u0131 ve dava a\u00e7acaklar\u0131n\u0131 s\u00f6yleyen Ethem Kuru\u015f, \u201cSavc\u0131l\u0131\u011f\u0131n temyiz ba\u015fvurusu \u00fczerine dosya Yarg\u0131tay incelemesine intikal edecektir.
