Aksine bu ifade; K\u00fcrdistan&#8217;daki gen\u00e7 kad\u0131nlara y\u00f6nelik organize \u015fiddetin bir \u00f6zeti ve bu ger\u00e7eklerin neden \u0131srarla g\u00f6rmezden gelindi\u011fine dair somut bir i\u015farettir. Rojin Kabai\u015f, Rojwelat K\u0131zmaz, G\u00fclistan Doku ve nicesi; san\u0131lan\u0131n aksine yaln\u0131zca bir adalet eksikli\u011fi veya g\u00fc\u00e7 odaklar\u0131n\u0131n sistematik s\u00f6m\u00fcr\u00fcs\u00fc de\u011fil, ayn\u0131 zamanda kurumsalla\u015fm\u0131\u015f ve organize bir \u015fiddet prati\u011finin d\u0131\u015favurumudur. Mevcut ataerkil yap\u0131 ve geleneksel aile bask\u0131s\u0131n\u0131n yan\u0131 s\u0131ra, b\u00f6lgedeki organize yap\u0131lar\u0131n yol a\u00e7t\u0131\u011f\u0131 kad\u0131n k\u0131r\u0131m\u0131; gen\u00e7 kad\u0131nlar\u0131 hedef alarak onlar\u0131 gelecek ideallerinden ve ya\u015fam alanlar\u0131ndan koparmaktad\u0131r. Gittik\u00e7e derinle\u015fen bu sorun K\u00fcrdistan\u2019daki kad\u0131nlar\u0131 geleceklerinden ve ideallerinden kopar\u0131p b\u00f6lgedeki eril tahakk\u00fcm\u00fc ve stat\u00fckoyu yeniden \u00fcretmektedir. Sistemli bir hal alan bu kay\u0131plar\u0131, cinayetleri ve bunlar\u0131n \u00f6zellikle gen\u00e7 kad\u0131nlar\u0131 nas\u0131l hedef ald\u0131\u011f\u0131n\u0131 kavrayabilmek i\u00e7in; b\u00f6lgedeki zorla kaybetme gelene\u011finin tarihsel ve siyasal arka plan\u0131n\u0131 analiz etmeliyiz.<\/p>\n<p><strong>K\u00fcrdistan&#8217;da Zorla Kaybetme Gelene\u011fi<\/strong><\/p>\n<p>T\u00fcrk Silahl\u0131 Kuvvetleri b\u00fcnyesinde kurulan J\u0130TEM; 1995\u2019ten bu yana kay\u0131plar\u0131n\u0131n ak\u0131betini soran Cumartesi Anneleri gibi bir direni\u015f oda\u011f\u0131n\u0131n ve toplumsal haf\u0131zan\u0131n olu\u015fmas\u0131na sebebiyet vermi\u015f bir organizasyondur. \u00d6yle ki bu organizasyonun faaliyetleri; b\u00f6lgedeki pek \u00e7ok k\u00f6y\u00fcn bo\u015falt\u0131lmas\u0131na, zorunlu g\u00f6\u00e7 dalgalar\u0131na ve binlerce sivilin ya\u015fam\u0131n\u0131 yitirmesine yol a\u00e7m\u0131\u015ft\u0131r. \u00d6zellikle 90\u2019l\u0131 y\u0131llarda zirve noktas\u0131na ula\u015fan bu sistematik \u015fiddet politikas\u0131 sonucunda; 1990-2011 y\u0131llar\u0131 aras\u0131nda i\u015flenen toplam faili me\u00e7hul cinayet say\u0131s\u0131 1.901\u2019e ula\u015fm\u0131\u015ft\u0131r. Bu cinayetler o kadar organize, sistemli ve pervas\u0131zd\u0131 ki; Beyaz Toros gibi nesneler bu kirli organizasyonun simgesi haline geldi. K\u00fcrdistan\u2019\u0131n en i\u015flek yerlerinde, g\u00fcn ortas\u0131nda i\u015flenen cinayetlerin failleri ise mutlak bir cezas\u0131zl\u0131k z\u0131rh\u0131yla korundu.<\/p>\n<p>Bu insanl\u0131k su\u00e7lar\u0131n\u0131n sistemsel derinli\u011fi; g\u00fcn\u00fcm\u00fcze kadar direnen Cumartesi Anneleri\u2019nin m\u00fccadelesinde ve h\u00e2l\u00e2 \u00e7ocuklar\u0131n\u0131n ya da e\u015flerinin ak\u0131betini soran binlerce insan\u0131n adalet aray\u0131\u015f\u0131nda a\u00e7\u0131k\u00e7a g\u00f6r\u00fclmektedir. &#8216;Ter\u00f6rle m\u00fccadele&#8217; ad\u0131 alt\u0131nda K\u00fcrt halk\u0131n\u0131n iradesi k\u0131r\u0131lmak istenmi\u015f, bu s\u00fcre\u00e7te m\u00fccadeleyle hi\u00e7bir ba\u011f\u0131 olmayan k\u00fc\u00e7\u00fck \u00e7ocuklar dahi bu \u015fiddet sarmal\u0131n\u0131n hedefi olmu\u015ftur. 90\u2019l\u0131 y\u0131llarla s\u0131n\u0131rl\u0131 kalmayan bu sistematik durum, 2004 y\u0131l\u0131nda 12 ya\u015f\u0131ndayken 13 kur\u015funla katledilen U\u011fur Kaymaz cinayetinde de kendini g\u00f6stermektedir. U\u011fur Kaymaz\u2019\u0131n \u00f6ld\u00fcr\u00fcld\u00fc\u011f\u00fc Mardin K\u0131z\u0131ltepe, tam da J\u0130TEM\u2019in 22 faili me\u00e7hul cinayete imza att\u0131\u011f\u0131 mek\u00e2nd\u0131r.<\/p>\n<p>G\u00fcn\u00fcm\u00fcze kadar uzanan bu organizasyonel yap\u0131, hukuki \u00e7er\u00e7evede ne kadar &#8216;dayanakl\u0131&#8217; k\u0131l\u0131nd\u0131ysa da ger\u00e7ek adalet hi\u00e7bir zaman tesis edilmedi. Bug\u00fcn h\u00e2l\u00e2 bu \u00f6r\u00fcnt\u00fcn\u00fcn bir devam\u0131 olarak, sava\u015f politikalar\u0131n\u0131n yo\u011funla\u015ft\u0131\u011f\u0131 \u015e\u0131rnak, Dersim, Wan ve Colem\u00earg gibi kentlerde; failin asker, polis veya jandarma oldu\u011fu pek \u00e7ok cinayet, tecav\u00fcz ve fuhu\u015f \u00e7etesi arac\u0131l\u0131\u011f\u0131yla K\u00fcrdistan&#8217;daki gen\u00e7 kad\u0131nlar sistematik olarak hedef al\u0131nmaktad\u0131r. Bu sebeple G\u00fclistan Doku ve Rojin Kabai\u015f gibi vakalar bir su\u00e7tan \u00f6te, onlarca y\u0131ll\u0131k bir devlet \u015fiddeti gelene\u011finin ve bu gelene\u011fi m\u00fcmk\u00fcn k\u0131lan cezas\u0131zl\u0131k k\u00fclt\u00fcr\u00fcn\u00fcn g\u00fcn\u00fcm\u00fczdeki yans\u0131malar\u0131d\u0131r.<\/p>\n<p><strong>Neden Gen\u00e7 Kad\u0131nlar?<\/strong><\/p>\n<p>Bu sorunun cevab\u0131 tek boyutlu olmamakla birlikte, K\u00fcrdistan\u2019daki kad\u0131nlar\u0131n ta\u015f\u0131d\u0131\u011f\u0131 \u00e7ifte kimlik ger\u00e7e\u011fi g\u00f6z \u00f6n\u00fcnde bulundurulmal\u0131d\u0131r. K\u00fcrt kimli\u011finin yan\u0131 s\u0131ra ataerkil d\u00fczeni sorgulayan \u00f6zneler olarak bu kad\u0131nlar; hem ulusal hem de cinsiyete dayal\u0131 iki ayr\u0131 iktidar eksenine ayn\u0131 anda meydan okumaktad\u0131rlar. Bu meydan okuma, onlar\u0131 salt bir birey olmaktan \u00e7\u0131kar\u0131r ve k\u00fclt\u00fcr\u00fc ta\u015f\u0131yan, dili ya\u015fatan, belle\u011fi aktaran ve d\u00f6n\u00fc\u015ft\u00fcren bir \u00f6zneye d\u00f6n\u00fc\u015ft\u00fcr\u00fcr. K\u00fcrt kad\u0131n\u0131, bir birey olman\u0131n \u00f6tesinde, mevcut iktidar yap\u0131lar\u0131 i\u00e7in stratejik bir tehdit unsuru olarak kodlanmaktad\u0131r. Bu ba\u011flamda, hem G\u00fclistan\u2019\u0131n hem de Rojin\u2019in \u00fcniversite \u00f6\u011frencisi gen\u00e7 kad\u0131nlar olmas\u0131 kritik bir \u00f6nem ta\u015f\u0131r. Kendi ayaklar\u0131 \u00fczerinde duran, e\u011fitimli bir K\u00fcrt kad\u0131n\u0131; asimilasyon politikalar\u0131 a\u00e7\u0131s\u0131ndan &#8216;alarm verici&#8217; bir \u00f6znedir. \u00c7\u00fcnk\u00fc kad\u0131n, asimilasyon zincirinin en diren\u00e7li halkas\u0131; k\u00fclt\u00fcr\u00fc, dili ve kolektif belle\u011fi ku\u015faktan ku\u015fa\u011fa aktaran temel ta\u015f\u0131y\u0131c\u0131d\u0131r. K\u00fcrt kimli\u011fi, hakim ulusal birlik anlay\u0131\u015f\u0131 i\u00e7erisinde bir &#8216;tehdit unsuru&#8217; olarak kodlan\u0131rken; e\u011fitimli gen\u00e7 K\u00fcrt kad\u0131n\u0131, bu kimli\u011fi hem ku\u015faklar aras\u0131 ta\u015f\u0131yan hem de modern bir bilin\u00e7le yeniden in\u015fa eden merkezi bir fig\u00fcrd\u00fcr.<\/p>\n<p><strong>Bir Silah Olarak Cinsel \u015eiddet<\/strong><\/p>\n<p>Kad\u0131n bedeni \u00fczerindeki tahakk\u00fcm y\u00f6ntemleri ve cinsel \u015fiddet, K\u00fcrdistan\u2019daki gen\u00e7 kad\u0131nlara \u00f6zg\u00fc m\u00fcnferit bir durum olmamakla birlikte; d\u00fcnyan\u0131n her yerindeki eril \u015fiddetle ayn\u0131 kaynaktan beslenmekte ve burada ayn\u0131 sistemli mant\u0131kla icra edilmektedir. Tarihsel ve k\u00fcresel bir \u00f6r\u00fcnt\u00fc olan bu eril hegemonya sorunu, K\u00fcrdistan\u2019da da kronik bir bi\u00e7imde ve derinle\u015ferek kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r. Tarihsel s\u00fcre\u00e7 boyunca kad\u0131n bedeni; sava\u015flarda adeta fethedilmesi gereken bir toprak par\u00e7as\u0131 veya el konulacak bir m\u00fclkiyet gibi g\u00f6r\u00fclerek do\u011frudan hedef al\u0131nm\u0131\u015ft\u0131r. \u0130\u015fgalci eril zihniyet, kad\u0131n bedenine sald\u0131rarak asl\u0131nda hedef ald\u0131\u011f\u0131 toplumun iradesini k\u0131rd\u0131\u011f\u0131n\u0131 ve onu yenilgiye u\u011fratt\u0131\u011f\u0131n\u0131 varsayar. Bu ba\u011flamda tecav\u00fcz, bir sald\u0131r\u0131dan ziyade sistematik bir &#8216;i\u015fgal arac\u0131&#8217; olarak i\u015flev g\u00f6r\u00fcr. Nitekim sava\u015flarda esir al\u0131nan erkeklere uygulanan en a\u011f\u0131r i\u015fkence y\u00f6ntemlerinden biri de e\u015fi, sevgilisi veya k\u0131z\u0131 gibi yak\u0131n\u0131ndaki kad\u0131nlara y\u00f6nelik tecav\u00fcz tehdididir. Bunlar ulusal politikan\u0131n bir par\u00e7as\u0131d\u0131r, stratejiktir.<\/p>\n<p><strong>G\u00fclistan Doku ve Cezas\u0131zl\u0131k D\u00f6ng\u00fcs\u00fc<\/strong><\/p>\n<p>K\u00fcrdistan bu \u00f6r\u00fcnt\u00fcn\u00fcn d\u0131\u015f\u0131nda de\u011fil, i\u00e7indedir. Ancak buradaki cinsel \u015fiddeti \u00f6zg\u00fcn k\u0131lan \u015fey, failin \u00e7o\u011fu zaman devlet \u00fcniformas\u0131 ta\u015f\u0131mas\u0131d\u0131r ve bu \u00fcniforman\u0131n, \u015fiddeti de\u011fil failleri korumas\u0131d\u0131r. Y\u0131llar i\u00e7inde dosyaya giren yeni beyanlar ve teknik veriler intihar ihtimalinin \u00f6tesinde bir zorla kaybetme veya cinayet \u015f\u00fcphesini g\u00f6zler \u00f6n\u00fcne serse de, devletin ilgili mekanizmalar\u0131 \u0131srarla G\u00fclistan Doku\u2019nun \u015f\u00fcphelilerinin \u00fczerine gitmekten ka\u00e7\u0131nm\u0131\u015ft\u0131r. G\u00fclistan Doku davas\u0131 bu y\u00fczden bir cinayet davas\u0131 olman\u0131n \u00f6tesinde \u00f6zel sava\u015f doktrininin kad\u0131n bedeni \u00fczerinden i\u015fletilen kolunun \u015fiddet, \u00f6rtbas, kurumsal koruma ve cezas\u0131zl\u0131k d\u00f6ng\u00fcs\u00fcn\u00fcn bir \u00fcniversite \u00f6\u011frencisinin bedeninde yeniden \u00fcreyen somut belgesidir. \u0130lk g\u00fcnden itibaren \u201cintihar\u201d \u00e7er\u00e7evesine s\u0131k\u0131\u015ft\u0131r\u0131lan G\u00fclistan Doku vakas\u0131; d\u00f6nemin Dersim Valisi\u2019nin o\u011flu hakk\u0131nda y\u00fcr\u00fct\u00fclen iddialara ra\u011fmen, valilik makam\u0131n\u0131n g\u00f6lgesinde ilerleyen ve adli bir soru\u015fturmadan \u00e7ok sistematik bir \u201cdosya kapatma\u201d mekanizmas\u0131na d\u00f6n\u00fc\u015fen bir s\u00fcre\u00e7 h\u00e2line geldi. Arama \u00e7al\u0131\u015fmalar\u0131n\u0131n ba\u015f\u0131nda d\u00f6nemin Dersim Valisi Tuncay Sonel vard\u0131. Yani soru\u015fturmay\u0131 y\u00f6neten el, asl\u0131nda ba\u015f \u015f\u00fcphelinin babas\u0131 olan ki\u015finin eliydi. Sistemin nas\u0131l i\u015fledi\u011fini anlamak i\u00e7in bu tek c\u00fcmle yeterliydi. Gittik\u00e7e b\u00fcy\u00fcyen fakat titizlikle gizlenen dosya; cinsel \u015fiddetten \u015f\u00fcpheli gebelik iddias\u0131na kadar uzanan, her halkas\u0131 ayr\u0131 bir su\u00e7la \u00f6r\u00fclm\u00fc\u015f devasa bir \u00f6rtbas zincirine i\u015faret ediyordu. Alt\u0131 y\u0131ll\u0131k yalan r\u00fczgar\u0131n\u0131n sonunda nihayet g\u00f6zalt\u0131na al\u0131nan Tuncay Sonel\u2019in sarf etti\u011fi, &#8216;Ben devletin valisiyim, emniyette ifade vermem&#8217; s\u00f6zleri; 90&#8217;lardan bu yana kurulan sistemin kendini ele vermesiydi. K\u00fcrdistan\u2019daki kad\u0131nlar, ku\u015fat\u0131lan meydanlarda ve barikatlar\u0131n \u00f6n\u00fcnde &#8216;Jin, Jiyan, Azad\u00ee&#8217; slogan\u0131n\u0131 sadece bir slogan de\u011fil, bir ya\u015fam savunmas\u0131 olarak hayk\u0131r\u0131yor. Aileler, her g\u00fcn yeni tehditlerle ku\u015fat\u0131lm\u0131\u015f bir hayat s\u00fcrseler de \u00e7ocuklar\u0131n\u0131n adaleti i\u00e7in tek bir geri ad\u0131m bile atm\u0131yorlar. K\u00fcrdistan\u2019daki bu sistematik \u00f6r\u00fcnt\u00fc mutlaka belgelenecek, karanl\u0131kta b\u0131rak\u0131lan t\u00fcm isimler ve failler bir g\u00fcn g\u00fcn y\u00fcz\u00fcne \u00e7\u0131kar\u0131lacakt\u0131r.
